Eligibility
You must be at least 16 years old, or the minimum age of digital consent in your country if that is higher, to use Bondi. If you are under 18 you may need consent from a parent or guardian and must be legally able to enter into contracts where you live.
If you use Bondi on behalf of a company or organisation, you confirm that you are authorised to bind that entity to these terms.
You may not use Bondi if you are barred from doing so under applicable sanctions or export control laws.
Accounts
You are responsible for the accuracy of the information in your account, for keeping your credentials secure and for all activity carried out through your account.
Notify us immediately at hello@bondi.com if you believe your account has been accessed without authorisation.
You may not share, sell or transfer an account, and you may not create an account using a false identity or on behalf of another person without permission.
Content ownership
You retain ownership of the content you create and upload, including portfolio work, briefs, concepts and messages.
You grant Bondi a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your content solely to operate, secure and promote the platform. For promotion beyond the platform we will ask you first.
Bondi retains all rights in the platform itself, including software, design, trade marks and documentation.
Creator submissions
When a creator submits a concept to a campaign, the creator retains ownership of that concept unless and until rights are transferred or licensed under an agreed collaboration.
Submitting a concept does not entitle a creator to selection or payment. Selection is at the brand's discretion, based on fit with the brief.
Brands must not use, reproduce or adapt an unselected submission without the creator's written agreement and appropriate compensation. Doing so is a breach of these terms and may also breach applicable law.
Creators must only submit original work they have the right to submit, and must disclose any third-party material included in a concept.
Campaigns
Brands are responsible for the accuracy and legality of their briefs, including budget ranges, deliverables, timelines and any claims to be made about products or services.
Material changes to a live campaign must be communicated to creators who have already submitted.
Bondi may remove a campaign that breaches these terms, our Community Guidelines, or applicable law.
Payments
Fees for a collaboration are agreed between the brand and the creator within the campaign and may be tied to milestones and approval checkpoints.
Brands agree to fund and release payment for approved deliverables in line with the agreed terms. Creators agree to deliver what was agreed, on time and to the described standard.
Platform fees, where they apply, are disclosed before you commit to a plan or collaboration. Taxes are your responsibility unless the law requires us to collect them.
Payments are processed by third-party payment providers and are subject to their terms.
Intellectual property
You must not upload content that infringes another party's intellectual property, privacy, publicity or other rights.
If you believe content on Bondi infringes your rights, contact legal@bondi.com with a description of the work, the location of the material and your contact details. We remove infringing material and may suspend repeat infringers.
Acceptable use
You must not misuse the platform: no harassment, discrimination, fraud, spam, scraping, reverse engineering, security circumvention, malware, or attempts to interfere with other users' access.
You must not misrepresent your identity, your work or your results, and you must not use the platform to solicit off-platform arrangements that avoid agreed terms or protections.
Termination
You may stop using Bondi and close your account at any time.
We may suspend or terminate access if you breach these terms, if required by law, or if your use poses a risk to other users or the platform. Where reasonable we will give notice and an opportunity to remedy.
Termination does not affect obligations already incurred, including payment for completed work.
Disclaimers
Bondi provides the platform that connects brands and creators. We are not a party to the creative agreements formed between them and we do not guarantee the quality, legality or outcome of any collaboration.
The platform is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the maximum extent permitted by law, Bondi is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
Our total liability arising out of or relating to these terms is limited to the greater of the amounts you paid to Bondi in the twelve months before the event giving rise to the claim, or one hundred US dollars.
Nothing in these terms limits liability that cannot be limited under applicable law, including for fraud or death or personal injury caused by negligence.
Indemnity
You agree to indemnify Bondi against claims, damages and reasonable costs arising from your content, your use of the platform, or your breach of these terms or of applicable law.
Dispute resolution
If a dispute arises, contact us first at legal@bondi.com. Most issues are resolved informally within thirty days.
If informal resolution fails, the parties agree to attempt mediation before commencing proceedings, except where urgent injunctive relief is required.
Disputes between a brand and a creator about a specific collaboration are between those parties; Bondi may provide records and assistance but is not the decision maker.
Governing law
These terms are governed by the laws of the jurisdiction in which the Bondi contracting entity is established, without regard to conflict-of-law rules, and the courts of that jurisdiction have non-exclusive jurisdiction.
If you are a consumer, you keep the benefit of any mandatory protections available under the law of your country of residence.
Changes to these terms
We may update these terms as the platform develops. Material changes will be notified through the platform or by email before they take effect. Continuing to use Bondi after that date means you accept the updated terms.
